Last updated: January 2025

1. Acceptance of Terms

By accessing or using homail ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

homail is a transactional email delivery service that enables developers and businesses to send automated emails via API. The Service includes email sending, delivery tracking, bounce management, and related features.

3. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk email (spam)
  • Transmit unlawful, harmful, or fraudulent content
  • Impersonate any person or organisation
  • Violate any applicable laws or regulations, including GDPR and CAN-SPAM
  • Interfere with or disrupt the Service or its infrastructure

4. Account Responsibilities

You are responsible for maintaining the security of your account credentials and API keys. You are liable for all activity that occurs under your account. Notify us immediately of any unauthorised access.

5. Service Use and Quotas

Homail is provided for internal projects and approved client workspaces. Usage limits are managed locally by administrators and may be changed or reduced to protect service reliability.

6. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance where possible. We are not liable for losses arising from service outages.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We process personal data only as described there.

8. Intellectual Property

The Service and its content are owned by homail and its licensors. You retain ownership of content you transmit through the Service. You grant us a limited licence to process your content solely to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by law, homail is not liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Use is provided on a best-effort basis unless a separate written agreement says otherwise.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately for breach of these terms. Upon termination, your right to access the Service ceases and we will handle your data per our data retention policy.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or a prominent notice in the Service. Continued use after the effective date constitutes acceptance.

12. Governing Law

These terms are governed by the laws of Ireland. Disputes shall be subject to the exclusive jurisdiction of the Irish courts.
